Privacy Policy

Firehouse Subs of Canada, ULC, the proud owner of the FIREHOUSE SUBS® restaurant brand, knows that your privacy is important. This Privacy Policy sets out our privacy practices that apply when you use any FIREHOUSE SUBS® branded website, mobile or tablet application (“App”), digital in-restaurant kiosk, or other FIREHOUSE SUBS® online service or platform, as well as our other interactions with you, including on third party platforms (such as social media).

 

Personal information collected when you interact with our services

1. Information We Collect and Use

We may collect and use information about you (“personal information”) when you:

·         Buy or use our products or services, including when you visit one of our restaurants or place an order for pick-up or delivery

·         Create an account through our App or website

·         Participate in Firehouse Rewards

·         Sign-up to receive marketing emails such as newsletters, offers and promotions

·         Enter a contest or participate in an event or promotion

·         Donate to one of our fundraising or community initiatives

·         Apply for a job  

·         Contact us with a comment, question or complaint

 

 

Personal information collected through the app

Buying or Using our Products and Services.

·         Using our App or website: When you use App or website to purchase a product or service, we may collect information such as your name, phone number, email address, delivery address, ordered products and your payment information (for example, payment card number, expiry date and CVV/CVC code). This information is used to process, fulfill and deliver your request, and, if you are a Firehouse Rewards member, may be used for the purposes of tailoring offers to you. See “Interest-Based Advertisements” below for more information, including how to opt-out of tailored offers.

How your Firehouse Rewards information is used

 

 

Firehouse Rewards. When you create an account to use our App or website, we will enroll you in our Firehouse Rewards program.

To access most of our App or website services (e.g., ordering through the App), you will be required to create an account and we may ask you to provide personal information such as your name, email address, phone number, birth date or language preference. We use this information to create and administer your online account, complete your orders including pick-up and delivery orders, and facilitate your participation in the Firehouse Rewards program.

Your Firehouse Rewards account information, including your use of our App or website (e.g., the features with which you interact), your past purchase behaviour, and loyalty status, will be used for the purposes of providing you with access to exclusive offers, sweepstakes, games and promotions that may be of interest to you. See “Interest-Based Advertisements” below for more information, including how to opt-out of tailored offers. ·         Push Notifications: With your consent, we may display push notifications on your mobile device about Firehouse Rewards promotional offers and other events, contests and promotions. If you wish to stop receiving push notifications from us, you can turn off push notifications in the App.

Information collected about your device and usage of our services

Information About Your Use of our Services. In addition to the information you provide to us directly, we (and our third-party service providers on our behalf) may collect information about your use of our services, including the App and website. We use this information to help us understand the activity on the App and our website, to monitor and improve our products and services, the App and our website, to manage and analyze data in order to better understand our users, and to tailor your experience when using our services. For example, we may collect:

·         Device information - such as your hardware model, IP address, other unique device identifiers, operating system version, and settings of the device you use to access our services.

·         Usage information - such as information about the services you use, the time and duration of your use of our App or website, what portions of our App or website you use, how often you use them, what links or materials (including advertising) you click when using our App or website, whether you open the emails we send, what materials (including advertising) you view when using our App or website, whether you make a purchase after seeing or clicking advertising we serve, the search terms you use, and other information about your interaction with content offered through our App and website, and any information stored in cookies and similar technologies that we have set on your device.

·         Location information - such as your computer’s IP address or general location (e.g. city/town/province/country), or with your express consent, your mobile device’s GPS-based location. Your location information is used to help you find local restaurants and to provide you with relevant offers and deals available near you. You can adjust your location preferences at any time in your device settings.

As with many online services, certain limited data is required for the App or website to function on/with your device. This data includes the type of device hardware and operating system, unique device identifier, IP address, language settings, and the date and time the App or website access our servers. In addition, we may use third party service providers to collect analytical information about your use of the App or website, such as the feature you use and/or time spent on the App or website, collectively for the purposes of helping us to improve the app and website experience for all users and to manage and analyze data in order to better understand our users.

We may also monitor use of our App, website and services by our guests in order to detect, investigate or prevent any actual or potential violation of our terms and conditions.

We may generate aggregated, non-identifiable data and use such information to monitor the performance, use and stability of the App, website and our services and to improve the App, website and our services.

Marketing

Marketing Communications.  If you sign-up to receive email marketing communications from us about products, services, events, programs, promotions, and special offers that may interest you, you can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. Please note that you may continue to receive transactional or account-related communications from us.

Promotions

Contests and Promotions. When you enter a contest or participate in a promotion, we may collect your name, address, email address, phone number, and any additional information or content required for the contest or promotion, including to deliver a prize to you, or that you otherwise provide, including your social media handle, profile picture and public posts or comments you make about our contest on social media networks. We use this information to administer the contest or promotion. As part of a contest or promotion, we may also share or otherwise publish the content you submit to us.

Charitable initiatives

Donations and Fundraising. If you choose to participate in one of our fundraising activities, we may collect information such as your name, email address, mailing address, phone number, billing address, payment information, and tribute details (if your donation is dedicated to another person). For specific donations, we may require additional information to facilitate the donation and we will request this information directly from you.

Job applications

Employment. In connection with a job application or related inquiry, you may provide us with certain personal information about yourself (such as that contained in a resume, cover letter, or similar employment-related materials). We use this information for the purpose of processing and responding to your application for current and future career opportunities.

Customer service

To Respond to You. When you contact us, we may collect information that identifies you (such as your name, address and a phone number) along with any information you provide in your communications and additional information we need to help us promptly answer your question or respond to your comment. We retain this information to assist you in the future and to improve our customer service, products and services.

Other information collected with your consent

Other Information We Collect. We also may collect and use other information about you, your device, or your use of our services in ways that we describe to you at the point of collection or otherwise with your consent.

Our retention practices

Personal Information Storage Time. We will keep your personal information for as long as it is needed to fulfil the purposes for which it was collected and in order to comply with legal or regulatory requirements. This may mean that some information is held for longer than other information.

 

 

2. Sharing of Personal Information

The following provides information about entities with which we may share your personal information. Our practices vary depending on the type of information and sharing.

With our franchisees

Franchisees. We may share information with local owners of FIREHOUSE SUBS® restaurants, particularly when they will work with us in delivering services to you. For example, local restaurants will implement delivery and take-away services that you may request through our App or website. We also may provide our franchisees with information so that a local restaurant may provide you with offers and promotions that might interest you. Please note that when you interact with our franchisees directly, they may provide you with separate notice and collect certain personal information for the purposes they identify or to respond to your question, compliment, or complaint.

With our business partners

Business Partners. We may also share limited information with business partners to provide you with services that you request. For example, if you sign up for a promotion that runs on our App or website but that is sponsored or co-sponsored by another company, your information may be shared with that sponsor. We are not responsible for the privacy practices of these entities and recommend you review their privacy policies carefully.

With our service providers

Service Providers. We may transfer information with companies providing services on our behalf, such as delivery services, hosting vendors, advertising service providers, data analytics companies, marketing service companies, and list managers. We also may disclose your information, including your payment information, as appropriate to process your payments for the products or services you request. Our service providers are given the information they need to perform their designated functions, and we do not authorize them to use or disclose personal information for their own marketing or other unrelated purposes. Our service providers may be located in Canada, the U.S., or other foreign jurisdictions.

With our advertising partners

Companies that Provide Content, Advertising, or Functionality. Some of the content, advertising, and functionality on our App and website may be provided by third parties, such as advertisers we engage. These companies may collect or receive certain information about your use of our App and website, including through the use of cookies, beacons, and similar technologies, and this information may be combined with information collected across different websites and online services in order to deliver ads that are more relevant to you, both on and off our App and website.

When required by law or to protect our guests and legal interests

Other Parties When Required or Permitted by Law, or As Necessary to Protect Our Guests and Services. We, and the third parties we engage(including affiliates), may use and share your personal information as we believe is necessary or appropriate to protect, enforce, or defend our or our affiliates’ legal rights, privacy, safety, or property, our employees or agents or guests, to detect, suppress or prevent fraud or where otherwise required or permitted by applicable law or legal process, including responding to a search warrant or other legally valid requests from public and government authorities (which may include lawful access by Canadian, U.S., or other governmental authorities, courts or law enforcement agencies).

With our fundraising partners

Other Parties in Connection with Donations and Fundraising. We may share your information with our fundraising partners when you choose to donate to one of their initiatives.

When necessary, in connection with a corporate transaction

Other Parties in Connection With a Corporate Transaction. We reserve the right to transfer any information we have about you in the event that we sell or transfer all or a portion of our business or assets to a third party, such as in the event of a merger, acquisition, or in connection with a bankruptcy reorganization or other change in corporate control.

With others parties, with your consent

Otherwise With Your Consent or at Your Direction. In addition to the sharing described in this Privacy Policy, we may share information about you with third parties whenever you consent to or direct such sharing.

 

 

3. Online Advertising and Cookies

We and other companies that provide advertising and other services may use cookies, web beacons, and similar technologies to facilitate administration and navigation, to better understand and improve our services, to determine and improve the advertising shown to you on our App and website or elsewhere, and to provide you with a customized online experience, including by providing you with personalized content and ads that are more relevant to you.

Our interest-based advertising practices

Interest-Based Advertisements. We may use third parties to serve advertisements on our App, website and on other websites and digital platforms. These companies may use cookies, web beacons or similar technologies to report certain information about your visits to our App or website and other websites (including usage information, such as web pages or other content you interact with and your response to ads) in order to measure the effectiveness of our and third-party advertiser marketing campaigns and to deliver ads that are more relevant to you, both on and off our App and website. We may also use services provided by third parties (such as social media platforms) to serve targeted ads to you and others on such platforms. For example, we may provide a hashed version of your email address or other information to the platform provider to facilitate the delivery of tailored advertising. Information about cookies

Cookies. “Cookies” are small files that are placed on your computer or other device when you visit a website. Cookies may be used to store a unique identification number tied to your computer or device so that you can be recognized as the same user across one or more browsing sessions, and across one or more sites. Cookies serve many useful purposes. For example:

• Cookies can remember your sign-in credentials, so you do not have to enter those credentials each time you visit our website.

• Cookies can help us and third parties understand which parts of our website are the most popular because they help us see which pages and features visitors access and how much time they spend on the pages. By studying this kind of information, we are better able to adapt our website and provide you with a better experience.

• Cookies help us and third parties understand which ads you have seen so that you don’t receive the same ad each time you visit our website.

Most browsers accept cookies automatically but can be configured not to do so. If you wish to disable cookies, refer to your browser help menu to learn how to disable cookies. Your opt-out only applies to the web browser you use so you must opt-out of each web browser on each device you use. Once you opt out, if you delete your browser’s saved cookies, you will need to opt-out again. If you disable cookies, it may interfere with the functioning of our website.

Information about beacons

Beacons. We, along with third parties, also may use technologies called beacons (or “pixels”) that communicate information from your device to a server. Beacons can be embedded in online content, videos, and emails, and can allow a server to read certain types of information from your device, know when you have viewed particular content or a particular email message, determine the time and date on which you viewed the beacon, and the IP address of your device. We and third parties use beacons for a variety of purposes, including to analyze the use of our website and (in conjunction with cookies) to provide content and ads that are more relevant to you both on and off our website.

Our use of do-not-track signals

Do-Not-Track Signals and Similar Mechanisms. Some web browsers may transmit “do-not-track” signals to the websites with which the user communicates. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether guests intend for these signals to be transmitted, or whether they even are aware of them. Because there currently is no industry standard concerning what, if anything, websites should do when they receive such signals, our website currently does not take action in response to these signals. If and when a final standard is established and accepted, we will reassess how to respond to these signals.

Our use of other technologies

Local Storage & Other Tracking Technologies. We, along with third parties, may use other kinds of technologies in connection with our App and website. These technologies are similar to the cookies discussed above in that they are stored on your device and can be used to store certain information about your activities and preferences. However, these technologies may make use of different parts of your device from standard cookies, and so you might not be able to control them using standard browser tools and settings.

Our use of analytics services

Analytics: We may use a third party such as Google Analytics to help us gather and analyze information about the areas visited on our websites (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and our website. These third parties may use cookies and other tracking technologies. Please note that even if you opt-out of interest-based advertising, tracking technologies may still collect data for other purposes including analytics and you will still see ads from us, but the ads will not be targeted based on behavioural information about you.

Manage Your Account. You may access, modify or delete your account on the settings or profile page contained in your account, or by contacting the Privacy Officer at privacy@firehousesubs.com with such written request.
